- Your relationship with GetIQ
Your use of GetIQ products, software, services and web sites (referred to collectively as the "Services" in this document ) is subject to the terms of a legal agreement between you and Creafire. "Creafire" means Creafire Ltd., whose principal place of business is in Schaan, Principality of Liechtenstein (register number FL-0001.059.123-7). This document explains how the agreement is made up, and sets out some of the terms of that agreement.Unless otherwise agreed in writing with Creafire, your agreement with Creafire will always include, at a minimum, the terms and conditions set out in this document. These are referred to below as the "Universal Terms".
Your agreement with Creafire will also include the terms of any Legal Notices applicable to the Services, in addition to the Universal Terms. All of these are referred to below as the "Additional Terms". Where Additional Terms apply to a Service, these will be accessible for you to read either within, or through your use of, that Service.
The Universal Terms, together with the Additional Terms, form a legally binding agreement between you and Creafire in relation to your use of the Services. It is important that you take the time to read them carefully. Collectively, this legal agreement is referred to below as the "Terms".
If there is any contradiction between what the Additional Terms say and what the Universal Terms say, then the Additional Terms shall take precedence in relation to that Service
In order to use the Services, you must first agree to the Terms. You may not use the Services if you do not accept the Terms.
You can accept the Terms by:
(A) clicking to accept or agree to the Terms, where this option is made available to you by Creafire in the user interface for any Service; or
(B) by actually using the Services. In this case, you understand and agree that Creafire will treat your use of the Services as acceptance of the Terms from that point onwards.
You may not use the Services and may not accept the Terms if (a) you are not of legal age to form a binding contract with Creafire, or (b) you are a person barred from receiving the Services under the laws of the United States or other countries including the country in which you are resident or from which you use the Services.
Before you continue, you should print off or save a local copy of the Universal Terms for your records.
Where Creafire has provided you with a translation of the English language version of the Terms, then you agree that the translation is provided for your convenience only and that the English language versions of the Terms will govern your relationship with Creafire.
If there is any contradiction between what the English language version of the Terms says and what a translation says, then the English language version shall take precedence.
- Privacy Policy
At Creafire we recognize that privacy is important. This Privacy Policy applies to all of the products, services and websites offered by Creafire. or its subsidiaries or affiliated companies; collectively, Creafire's "services".
If you have any questions about this Privacy Policy, please feel free to contact us through our website.
We offer a number of services that do not require you to register for an account or provide any personal information to us. In order to provide our full range of services, we may collect the following types of information:- Information you provide - When you sign up for a service or promotion that requires registration, we ask you for personal information (such as your name, email address and an account password). For certain services we also request credit card or other payment account information which we maintain in encrypted form on secure servers. We may combine the information you submit under your account with information from other Creafire services or third parties in order to provide you with a better experience and to improve the quality of our services. For certain services, we may give you the opportunity to opt out of combining such information.
- Cookies - When you visit Creafire, we send one or more cookies - a small file containing a string of characters - to your computer that uniquely identifies your browser. We use cookies to improve the quality of our service by storing user preferences and tracking user trends.
- Log information - When you access Creafire services, our servers automatically record information that your browser sends whenever you visit a website. These server logs may include information such as your web request, Internet Protocol address, browser type, browser language, the date and time of your request and one or more cookies that may uniquely identify your browser.
- User communications - When you send email or other communications to Creafire, we may retain those communications in order to process your inquiries, respond to your requests and improve our services.
- Affiliated sites - We offer some of our services in connection with other web sites. Personal information that you provide to those sites may be sent to Creafire in order to deliver the service. We process such information in accordance with this Privacy Policy. The affiliated sites may have different privacy practices and we encourage you to read their privacy policies.
- Other sites - This Privacy Policy applies to Creafire services only. We do not exercise control over the sites displayed as search results or links from within our various services. These other sites may place their own cookies or other files on your computer, collect data or solicit personal information from you.
Creafire only processes personal information for the purposes described in this Privacy Policy and/or the supplementary privacy notices for specific services. In addition to the above, such purposes include:- Providing our services to users, including the display of customized content and advertising;
- Auditing, research and analysis in order to maintain, protect and improve our services;
- Ensuring the technical functioning of our network; and
- Developing new services.
You can find more information about how we process personal information by referring to the supplementary privacy notices for particular services.
Creafire processes personal information on our servers in several countries. In some cases, we process personal information on a server outside your own country. We may process personal information to provide our own services. In some cases, we may process personal information on behalf of and according to the instructions of a third party, such as our advertising partners.
Choices for personal information
When you sign up for a particular service that requires registration, we ask you to provide personal information. If we use this information in a manner different than the purpose for which it was collected, then we will ask for your consent prior to such use.
If we propose to use personal information for any purposes other than those described in this Privacy Policy and/or in the specific service privacy notices, we will offer you an effective way to opt out of the use of personal information for those other purposes. We will not collect or use sensitive information for purposes other than those described in this Privacy Policy and/or in the supplementary service privacy notices, unless we have obtained your prior consent.
Most browsers are initially set up to accept cookies, but you can reset your browser to refuse all cookies or to indicate when a cookie is being sent. However, some Creafire features and services may not function properly if your cookies are disabled.
You can decline to submit personal information to any of our services, in which case Creafire may not be able to provide those services to you.
Information sharing
Creafire only shares personal information with other companies or individuals outside of Creafire in the following limited circumstances:
- We have your consent. We require opt-in consent for the sharing of any sensitive personal information.
- We provide such information to our subsidiaries, affiliated companies or other trusted businesses or persons for the purpose of processing personal information on our behalf. We require that these parties agree to process such information based on our instructions and in compliance with this Privacy Policy and any other appropriate confidentiality and security measures.
- We have a good faith belief that access, use, preservation or disclosure of such information is reasonably necessary to (a) satisfy any applicable law, regulation, legal process or enforceable governmental request, (b) enforce applicable Terms of Service, including investigation of potential violations thereof, (c) detect, prevent, or otherwise address fraud, security or technical issues, or (d) protect against imminent harm to the rights, property or safety of Creafire, its users or the public as required or permitted by law.
Information securityWe take appropriate security measures to protect against unauthorized access to or unauthorized alteration, disclosure or destruction of data. These include internal reviews of our data collection, storage and processing practices and security measures, as well as physical security measures to guard against unauthorized access to systems where we store personal data.
Data integrity
Creafire processes personal information only for the purposes for which it was collected and in accordance with this Privacy Policy or any applicable service-specific privacy notice. We review our data collection, storage and processing practices to ensure that we only collect, store and process the personal information needed to provide or improve our services. We take reasonable steps to ensure that the personal information we process is accurate, complete, and current, but we depend on our users to update or correct their personal information whenever necessary.
Changes to this Privacy Policy
Please note that this Privacy Policy may change from time to time. We will not reduce your rights under this Privacy Policy without your explicit consent, and we expect most such changes will be minor. Regardless, we will post any Privacy Policy changes on this page.
- Use of the Services by you
In order to access certain Services, you may be required to provide information about yourself (such as identification or contact details) as part of the registration process for the Service, or as part of your continued use of the Services. You agree that any registration information you give to Creafire will always be accurate, correct and up to date.
You agree to use the Services only for purposes that are permitted by (a) the Terms and (b) any applicable law, regulation or generally accepted practices or guidelines in the relevant jurisdictions (including any laws regarding the export of data or software to and from the United States or other relevant countries).
You agree not to access (or attempt to access) any of the Services by any means other than through the interface that is provided by Creafire, unless you have been specifically allowed to do so in a separate agreement with Creafire. You specifically agree not to access (or attempt to access) any of the Services through any automated means (including use of scripts or web crawlers) and shall ensure that you comply with the instructions set out in any robots.txt file present on the Services.
You agree that you will not engage in any activity that interferes with or disrupts the Services (or the servers and networks which are connected to the Services).
Unless you have been specifically permitted to do so in a separate agreement with Creafire, you agree that you will not reproduce, duplicate, copy, sell, trade or resell the Services for any purpose.
You agree that you are solely responsible for (and that Creafire has no responsibility to you or to any third party for) any breach of your obligations under the Terms and for the consequences (including any loss or damage which Creafire may suffer) of any such breach.
- Content in the Services
You understand that all information (such as data files, written text, computer software, music, audio files or other sounds, photographs, videos or other images) which you may have access to as part of, or through your use of, the Services are the sole responsibility of the person from which such content originated. All such information is referred to below as the "Content".
You should be aware that Content presented to you as part of the Services, including but not limited to advertisements in the Services and sponsored Content within the Services may be protected by intellectual property rights which are owned by the sponsors or advertisers who provide that Content to Creafire (or by other persons or companies on their behalf). You may not modify, rent, lease, loan, sell, distribute or create derivative works based on this Content (either in whole or in part) unless you have been specifically told that you may do so by Creafire or by the owners of that Content, in a separate agreement.
Creafire reserves the right (but shall have no obligation) to pre-screen, review, flag, filter, modify, refuse or remove any or all Content from any Service.
You understand that by using the Services you may be exposed to Content that you may find offensive, indecent or objectionable and that, in this respect, you use the Services at your own risk.
You agree that you are solely responsible for (and that Creafire has no responsibility to you or to any third party for) any Content that you create, transmit or display while using the Services and for the consequences of your actions (including any loss or damage which Creafire may suffer) by doing so.
You retain copyright and any other rights you already hold in Content which you submit, post or display on or through, the Services. By submitting, posting or displaying the content you give Creafire a perpetual, irrevocable, worldwide, royalty-free, and non-exclusive license to reproduce, adapt, modify, translate, publish, publicly perform, publicly display and distribute any Content which you submit, post or display on or through, the Services. This license is for the sole purpose of enabling Creafire to display, distribute and promote the Services and may be revoked for certain Services as defined in the Additional Terms of those Services.
You agree that this license includes a right for Creafire to make such Content available to other companies, organizations or individuals with whom Creafire has relationships for the provision of syndicated services, and to use such Content in connection with the provision of those services.
You understand that Creafire, in performing the required technical steps to provide the Services to our users, may (a) transmit or distribute your Content over various public networks and in various media; and (b) make such changes to your Content as are necessary to conform and adapt that Content to the technical requirements of connecting networks, devices, services or media. You agree that this license shall permit Creafire to take these actions.
You confirm and warrant to Creafire that you have all the rights, power and authority necessary to grant the above license.
Creafire gives you a personal, worldwide, royalty-free, non-assignable and non-exclusive license to use the software provided to you by Creafire as part of the Services as provided to you by Creafire (referred to as the "Software" below). This license is for the sole purpose of enabling you to use and enjoy the benefit of the Services as provided by Creafire, in the manner permitted by the Terms.
You may not (and you may not permit anyone else to) copy, modify, create a derivative work of, reverse engineer, decompile or otherwise attempt to extract the source code of the Software or any part thereof, unless this is expressly permitted or required by law, or unless you have been specifically told that you may do so by Creafire, in writing.
Unless Creafire has given you specific written permission to do so, you may not assign (or grant a sub-license of) your rights to use the Software, grant a security interest in or over your rights to use the Software, or otherwise transfer any part of your rights to use the Software.
- Proprietary rights and software update
You acknowledge and agree that Creafire (or Creafire's licensors) own all legal right, title and interest in and to the Services, including any intellectual property rights which subsist in the Services (whether those rights happen to be registered or not, and wherever in the world those rights may exist). You further acknowledge that the Services may contain information which is designated confidential by Creafire and that you shall not disclose such information without Creafire's prior written consent.
Unless you have agreed otherwise in writing with Creafire, nothing in the Terms gives you a right to use any of Creafire's trade names, trade marks, service marks, logos, domain names, and other distinctive brand features.
If you have been given an explicit right to use any of these brand features in a separate written agreement with Creafire, then you agree that your use of such features shall be in compliance with that agreement, any applicable provisions of the Terms, and Creafire's brand feature use guidelines as updated from time to time.
You agree that you shall not remove, obscure, or alter any proprietary rights notices (including copyright and trade mark notices) which may be affixed to or contained within the Services.
Unless you have been expressly authorized to do so in writing by Creafire, you agree that in using the Services, you will not use any trade mark, service mark, trade name, logo of any company or organization in a way that is likely or intended to cause confusion about the owner or authorized user of such marks, names or logos.
The Software which you use may automatically download and install updates from time to time from Creafire. These updates are designed to improve, enhance and further develop the Services and may take the form of bug fixes, enhanced functions, new software modules and completely new versions. You agree to receive such updates (and permit Creafire to deliver these to you) as part of your use of the Services.
- Changes to the Terms
Creafire may make changes to the Universal Terms or Additional Terms from time to time. When these changes are made, Creafire will make a new copy of the Universal Terms available online and any new Additional Terms will be made available to you from within, or through, the affected Services.
You understand and agree that if you use the Services after the date on which the Universal Terms or Additional Terms have changed, Creafire will treat your use as acceptance of the updated Universal Terms or Additional Terms.
- Exclusion of warranties
Nothing in these terms shall exclude or limit Creafire's warranty or liability for losses which may not be lawfully excluded or limited by applicable law. Some jurisdictions do not allow the exclusion of certain warranties or conditions or the limitation or exclusion of liability for loss or damage caused by negligence, breach of contract or breach of implied terms, or incidental or consequential damages. Accordingly, only the limitations which are lawful in your jurisdiction will apply to you and our liability will be limited to the maximum extent permitted by law.
You expressly understand and agree that your use of the services is at your sole risk and that the services are provided "as is" and "as available."
In particular, Creafire, its subsidiaries and affiliates, and its licensors do not represent or warrant to you that:
(a) your use of the services will meet your requirements,
(b) your use of the services will be uninterrupted, timely, secure or free from error,
(c) any information obtained by you as a result of your use of the services will be accurate or reliable, and
(d) that defects in the operation or functionality of any software provided to you as part of the services will be corrected.Any material downloaded or otherwise obtained through the use of the services is done at your own discretion and risk and that you will be solely responsible for any damage to your computer system or other device or loss of data that results from the download of any such material.
No advice or information, whether oral or written, obtained by you from Creafire or through or from the services shall create any warranty not expressly stated in the terms.
Creafire further expressly disclaims all warranties and conditions of any kind, whether express or implied, including, but not limited to the implied warranties and conditions of merchantability, fitness for a particular purpose and non-infringement.
- Limitation of liability
Subject to overall provision above, you expressly understand and agree that Creafire, its subsidiaries and affiliates, and its licensors shall not be liable to you for:
(a) any direct, indirect, incidental, special consequential or exemplary damages which may be incurred by you, however caused and under any theory of liability.. This shall include, but not be limited to, any loss of profit (whether incurred directly or indirectly), any loss of goodwill or business reputation, any loss of data suffered, cost of procurement of substitute goods or services, or other intangible loss;
(b) any loss or damage which may be incurred by you, including but not limited to loss or damage as a result of:
(i) any reliance placed by you on the completeness, accuracy or existence of any advertising, or as a result of any relationship or transaction between you and any advertiser or sponsor whose advertising appears on the services;
(ii) any changes which Creafire may make to the services, or for any permanent or temporary cessation in the provision of the services (or any features within the services);
(iii) the deletion of, corruption of, or failure to store, any content and other communications data maintained or transmitted by or through your use of the services;
(iii) your failure to provide Creafire with accurate account information;
(iv) your failure to keep your password or account details secure and confidential;The limitations on Creafire's liability to you in paragraph 15.1 above shall apply whether or not Creafire has been advised of or should have been aware of the possibility of any such losses arising.
- General legal terms
Sometimes when you use the Services, you may (as a result of, or through your use of the Services) use a service or download a piece of software, or purchase goods, which are provided by another person or company. Your use of these other services, software or goods may be subject to separate terms between you and the company or person concerned. If so, the Terms do not affect your legal relationship with these other companies or individuals.
The Terms constitute the whole legal agreement between you and Creafire and govern your use of the Services (but excluding any services which Creafire may provide to you under a separate written agreement), and completely replace any prior agreements between you and Creafire in relation to the Services.
You agree that Creafire may provide you with notices, including those regarding changes to the Terms, by email, regular mail, or postings on the Services.
You agree that if Creafire does not exercise or enforce any legal right or remedy which is contained in the Terms (or which Creafire has the benefit of under any applicable law), this will not be taken to be a formal waiver of Creafire's rights and that those rights or remedies will still be available to Creafire.
If any court of law, having the jurisdiction to decide on this matter, rules that any provision of these Terms is invalid, then that provision will be removed from the Terms without affecting the rest of the Terms. The remaining provisions of the Terms will continue to be valid and enforceable.
You acknowledge and agree that each member of the group of companies of which Creafire is the parent shall be third party beneficiaries to the Terms and that such other companies shall be entitled to directly enforce, and rely upon, any provision of the Terms which confers a benefit on (or rights in favor of) them. Other than this, no other person or company shall be third party beneficiaries to the Terms.
The Terms, and your relationship with Creafire under the Terms, shall be governed by the laws of the Principality of Liechtenstein without regard to its conflict of laws provisions. You and Creafire agree to submit to the exclusive jurisdiction of the courts located within the Principality of Liechtenstein to resolve any legal matter arising from the Terms. Notwithstanding this, you agree that Creafire shall still be allowed to apply for injunctive remedies (or an equivalent type of urgent legal relief) in any jurisdiction.
Additional Terms for service GetIQ
- Specification of the service GetIQ and basic definitions
Creafire Ltd. ("Administrator") registered in Schaan, Principality of Liechtenstein (register number FL-0001.059.123-7), administers the service GetIQ, where the visitors ("Users") can find out their IQ and the IQ of their country.
Basic definitions:
IQ = Intelligence quotient (quotient = ratio, share) is an intelligence index, with a normal distribution with the average 100, and the standard deviation 15
Test = a combination of an assignment and possible types of answers, where the best correct logical solution is just one. The tests can evaluate different IQ types (natural intelligence, numeric intelligence, 3D, etc.) and are merged in one IQ value, the more precise the more tests the User filled in.
Terms of using the GetIQ services = terms defining the rights and duties of the subjects participating in GetIQ. The Administrator reserves the right to change the terms of use, and the change is effective as of the day of its publishing on the website.
Administrator = a subject which takes care of trouble free operation of the server and applications necessary for providing the service
User = visitor filling out a test, or somebody registering in the system
- Rights and duties of the participating subjects
Administrator:
- has the right to contact the User at any time, in any way regarding any matter,
- has the right to agree individual terms with other subject participating in GetIQ,
- has the right to suspend any User without giving any reason.
User:
- has the right to contact the GetIQ Administrator (by using contact link)
- has the right to announce termination of operating in GetIQ without giving any reason
- is obliged to abide the valid GetIQ terms
- after payment, the user has a right to find out the test result, and in case the result has been denied, he has the right to contact the Administrator and require remedy, but he is not entitled to require a remuneration.
- Payment systems
The payment systems are provided by the Administrator. The payment systems and the price for the results are determined by the location chosen by the user after filling out the test. In case the user chooses a different location than where is he located at the moment, he will more than likely not be able to have the access to the results at all. Prices and billing processes for each country can be found at the ordering page of each country.
This service is provided by Creafire AG. A fee of £8.00 (2 SMS x £4.00) will be charged on your mobile phone. This is not a subscription. Users must have sufficient credit to access this service. 16+ only. Please ask permission from the bill payer before sending these messages.
